Antigua Eats - Terms and Conditions

Welcome to Antigua Eats, a mobile application designed to provide restaurant and bar locator services for the island of Antigua and Barbuda. These Terms and Conditions ("Agreement") govern the submission process for restaurants and bars seeking to be listed on Antigua Eats.

By submitting your restaurant's details and agreeing to pay the applicable listing fee, you (the "Restaurant Owner" or "You") agree to be bound by the terms outlined below.

1. Eligibility for Listing

To be eligible for listing on Antigua Eats, your restaurant or bar must:

  • Operate within the jurisdiction of Antigua and Barbuda.
  • Comply with all local laws and regulations regarding health, safety, and business operation.
  • Provide accurate, truthful, and up-to-date information about your business.

2. Submission of Restaurant Details

Restaurant Owners are required to submit the following information for listing:

  • Restaurant Name
  • Address
  • Contact Information (email, phone number)
  • Business Hours
  • Cuisine Type
  • Menu (optional, if applicable)
  • Photos of the Restaurant/Bar (optional but encouraged)

Antigua Eats reserves the right to reject any submission that does not meet our criteria or violates our policies.

3. Listing Fee

The cost to have a restaurant listed on Antigua Eats is $1,200 Eastern Caribbean Dollars (EC$ 1,200) per year. The fee must be paid in full before your restaurant listing will be published.

Payment Terms:

  • Payment must be made online through our credit card processing agent, Stripe, or via bank transfer.
  • For payments via Stripe, please follow the instructions provided on our payment page to securely complete the transaction using a valid credit or debit card.
  • For bank transfers, please contact us directly to receive the necessary account details.
  • Listing fees are non-refundable.
  • Listings are valid for one (1) year from the date of payment. After one year, the restaurant listing will expire unless renewed by the Restaurant Owner or extend at the discretion of Antigua Eats.

4. Renewal of Listings

Restaurant Owners will be notified of the upcoming expiration of their listing 30 days before the end of the current term. Failure to renew before the expiration date may result in the removal of your restaurant's listing from the Antigua Eats platform.

5. Content Accuracy

You are responsible for ensuring the accuracy of the content you submit. Antigua Eats is not responsible for any errors or inaccuracies in the information provided by you. Any outdated or incorrect information can be updated by the Restaurant Owner directly or by contacting us.

6. Review and Modification of Listings

While we make every effort to maintain accurate and up-to-date listings, Antigua Eats reserves the right to:

  • Edit, modify, or remove any restaurant listing at our sole discretion if we believe the content violates our policies or is inaccurate.
  • Update restaurant details if the information submitted by the Restaurant Owner changes.

7. Prohibited Conduct

By submitting your restaurant details, you agree not to:

  • Submit false or misleading information.
  • Use the Antigua Eats platform for unlawful purposes, including but not limited to promoting harmful content or engaging in discriminatory practices.
  • Infringe upon the intellectual property rights of others, including using copyrighted images or logos without permission.

8. Intellectual Property

All content on the Antigua Eats platform, including logos, trademarks, and other materials, is the property of Antigua Eats or its affiliates. Restaurant Owners retain ownership of the content they submit (e.g., photos, descriptions), but grant Antigua Eats a non-exclusive, worldwide, royalty-free license to use, display, and distribute this content for promotional purposes related to the app.

9. Privacy and Data Collection

By submitting your restaurant details, you agree to the collection and use of your data in accordance with our Privacy Policy, which is incorporated by reference into this Agreement. We collect only the information necessary for providing the listing service, and we will not share or sell your data to third parties without your consent, except as required by law.

10. Termination of Listing

Antigua Eats reserves the right to suspend or terminate a restaurant's listing at any time, without notice or refund, if we determine that the restaurant has violated these Terms and Conditions or engaged in conduct detrimental to the platform.

11. Limitation of Liability

To the fullest extent permitted by law, Antigua Eats is not liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the app, restaurant listings, or any content provided on the platform.

12. Indemnification

Restaurant Owners agree to indemnify and hold harmless Antigua Eats, its affiliates, employees, and agents from any claims, damages, or losses arising out of the content submitted by the Restaurant Owner, or any violation of these Terms and Conditions.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Antigua and Barbuda.

14. Amendments

Antigua Eats reserves the right to update or modify these Terms and Conditions at any time. Any changes will be posted on this page, and your continued use of the service will constitute acceptance of those changes.
